JUDGMENT

[1]The Claimant is entitled to a declaration that:(i) he is owed 1 weeks’ notice pay,(ii) he has been subject to an unlawful deduction of his wages between the period 16 July 2021 to 28 June 2022; and(iii) he is entitled to his accrued but unpaid holiday pay outstanding on termination of his employment.[2]The amounts to which the Claimant is entitled are as follows: 2.1. The sum in respect of unlawful deductions from his wages between 16 July 2021 to 28 June 2022, being 11 months at a monthly salary of £2,500 gross per month is a total of £27,500.00, this sum is inclusive of one weeks’ notice pay. 2.2. The sum to which the Claimant is entitled for his unpaid holiday pay is £2,999.88 being 26 days at £115.38 per day. 2.3. The total sum owed to the Claimant is £30,499.88 gross. The amount given in this judgment is the gross figure the Claimant is entitled to the payment net of tax and national insurance, it is for the Respondent to calculate the Case Number: 3205207/2022 deductions and make those payments to HMRC. The Payment to the Claimant should be made within 14 days of the date of this judgment.
