The claim is struck out under Rule 37(1)(d) of The Employment Tribunals Rules of Procedure 2013 (as amended).REASONS
[1]By a case management order dated 10 June 2022 the Tribunal gave the Claimant an opportunity to make representations, as to why the claim should not be struck out because it has not been actively pursued. The Claimant was given until 24 June 2022 to respond. The Claimant has failed to respond.[2]Since submitted her claim on the 16 July 2021 the Claimant has failed to:• Complete a case management agenda sent to the parties on 4 August• Provide the full and correct name of her former employer as requested in a letter from the Tribunal dated 20 October 2021• Provide a schedule of loss and agreed schedule of issues as requested in the case management orders of 20 October 2021:• respond to the letter from the Tribunal dated 1 December 2021 requiring the parties to comply with the case management orders of 20 October 2021• attend the preliminary hearing by telephone on 9 June 2022.[3]The claim has not been actively pursued and is struck out under Rule 37(1)(d) of The Employment Tribunals Rules of Procedure 2013.[4]The hearing listed on 29-31 March 2023 is vacated.
