The complaint of Unfair Dismissal is struck out.

REASONS

[1]By a letter dated 25th August 2022 the Tribunal gave the claimant an opportunity to give reasons why your claim for unfair dismissal should not be struck out, because you did not have the required two years employment to bring such a claim. You did not reply to this letter.[2]Your claim for unfair dismissal is therefore struck out because you are not entitled to bring an unfair dismissal claim[3]The remaining claims are not affected by this and will continue.[1]The Respondent has failed to present a valid response on time. The Employment Tribunal has decided that a determination can properly be made of the claim in accordance with rule 21 of the ET rules of procedure and the concludes that the Respondent has made unauthorised deductions from the Claimants wages.[2]The Respondent has made unlawful deductions from the Claimants wages for March 2022 of £929.80[3]The Respondent made unauthorised deduction of wages from the Claimants wages for 1 - 13 April 2022 of £429.14[4]The respondent is ordered to pay a 25% uplift pursuant to non-compliance with the ACAS code amounting £339.74[5]The respondent must pay the claimant total sum of £1698.68[6]The hearing listed on 12 April 2023 is cancelled.
