JUDGMENT

[1]The Claimant was employed by the Respondent and was dismissed as redundant on 26 February 2021, when he was informed by letter that his employer was ceasing trading that day. The Respondent went into creditors voluntary liquidation on 15 March 2021.[2]The Respondent failed to comply with a requirement under s.188 of the Trade Union & Labour Relations (Consolidation) Act 1992 in respect of its duty to consult with an appropriate employee representative about redundancy.[3]The claim made by the Claimant is well founded and the Claimant is entitled to a protective award.[4]No mitigating circumstances, have been provided such as to justify a reduction of the award.[5]The Respondent shall pay to the Claimant remuneration for the protected period of 90 days beginning 26 February 2021 and ending 27 May 2021.
