Mr L Akula v John Lewis plc and Others: 3203189/2024
JUDGMENT
[1]In all the circumstances of the Claimant’s non-attendance today when he failed to attend or be represented, I am satisfied by reference to Rule 47 Employment Tribunal Procedure Rules 2024 (‘the 2024 Rules’) that, on the basis of the information available to me and having made such enquiries as are practicable about the reasons for his absence, I am able to proceed with the Hearing in his absence.[2]Under Rule 38(1)(e) of the 2024 Rules, on the application of the Respondents, I hereby STRIKE OUT and DISMISS strike out all the claims against each and all of the Respondents because I consider that it is no longer possible to have a fair hearing of any of the claims in this case. Case Number: 3203189/2024[3]I am satisfied that the Claimant has had a reasonable opportunity to make representations in writing and in person as to why his claims should not be struck out.
