The First Respondent has failed to enter a response to the Claimant’s claims. However, at the case management hearing on 11 May 2020 it was established that the First Respondent, as an individual was not the Claimant’s employer. The claims against the First Respondent are therefore dismissed. 2. The Second Respondent has failed to enter a response to the Claimant’s claims and pursuant to rule 21 of the Employment Tribunal Rules of Procedure 2013 judgment is issued in his favour in respect his unpaid wages claims, unpaid notice pay and unpaid holiday claims. 3. The Second Respondent is ordered to pay the Claimant the total sum of £3187.50 in respect of his claim. Employment Tribunals Rules of Procedure 2013 – Rule 21[1]The First Respondent has failed to enter a response to the Claimant’s claims.
