JUDGMENT

The claim for holiday pay is dismissed. There are no further outstanding issues.

REASONS

The Claimant had presented claims alleging unfair dismissal and claiming annual leave (holiday pay).[2]On 4 May 2020 following warnings, Judgment by Employment Judge struck out the claim of unfair dismissal as having no real prospect of success. The Claimant had only one month of qualifying service.[3]As to the claim for holiday pay, no details were supplied. The Claimant did not participate in this telephone hearing. Mr Brotherton for the Respondent confirmed that the Respondent has paid holiday pay to the Claimant who has acknowledged receipt and indicated that this is accepted and he has no further claim. He has not informed the Tribunal. However, Mr Brotherton confirmed that he emailed the Tribunal on 6 May with evidence of payment and undertook to send to the Tribunal a copy of the Claimant’s receipt.
