JUDGMENT
[1]The Claimant’s claim is dismissed on withdrawal by the Claimant, it having been identified that the Employment Tribunal does not have jurisdiction to hear a discrimination claim under the Equality Act which falls within Part 3 of the Equality Act 2010 (services and public functions). The Claimant was not bringing a claim for discrimination against his employer.[2]If there is such a public function/services discrimination claim, that claim has to be brought in the County Court (s114 Equality Act 2010).[3]The Claimant had not appreciated that the terms of the Equality Act 2010 meant he could not bring this kind of claim in the Employment Tribunal, until explained and discussed with him at this hearing. In the light of those discussions he withdrew his claim. Case Number: 3202575/2020
