JUDGMENT
[1]The 1st respondent, C3 Imaging Ltd, was at the relevant time for the purposes of these claims the employer of the claimants.[2]The 2nd respondent, Mr John Mooney, was not at the relevant time for the purposes of these claims the employer of the claimants and he did not otherwise have legal or contractual liability to them so far as the present claims are concerned.[3]Accordingly, acting under rule 34, it appears to the Tribunal that the 2nd respondent, Mr John Mooney, has been wrongly included as a party to the proceedings and he is hereby removed as a respondent.[4]An application for costs made by the 2nd respondent against the claimants was refused. 1 of 2 Case Numbers: 3202552/2021; 3202557/2021 3202563/2021; 3202569/2021 3202585/2021; 3205151/2021 3205156/2021; 3205161/2021 3205168/2021; 3205179/2021[5]The claims now proceed to a final hearing as listed on 19-20 January 2023.
