EMPLOYMENT TRIBUNALS
Case No 3202406/2020
Mr J RobertsClaimantBSM Packaging Supplies LimitedRespondent
Employment Judge CrosfillDate 6 March 2021

JUDGMENT

The claim is struck out.

REASONS

[1]By a letter dated 11 January 2021 the Tribunal gave the claimant an opportunity to make representations as to why the claim should not be struck out because it had no reasonable prospect of success as it is highly likely that by the end of his employment, the Claimant had been paid all money that was due to him; the Claimant failed to attend the hearing on 11 January 2021 and failed to notify the Tribunal and the Respondent that he was not going to attend. the Claimant failed to provide any documents or statements supporting his claim that the Respondent withheld holiday pay or furlough pay from him it has not been actively pursued.[2]The claimant has failed to make representations in writing, or has failed to make any sufficient representations, why this should not be done or to request a hearing. The claim is therefore struck out.
