Miss J Butler v Motability: 3202065/2023
JUDGMENT
The claim is struck out.REASONS
[1]By a letter dated 4th June 2024 the Tribunal gave the claimant an opportunity to make representations or to request a hearing, as to why the claim should not be struck out because:• the Claimant failed to comply with the order requiring her to provide a Schedule of Loss by 21 March 2023;• the Claimant did not provide any answers to the questions relating to sexual orientation discrimination posed by the Respondent in the draft List of Issues sent to her in accordance with the tribunal’s order – which was responded to in part by the Claimant on 4 April 2024 (but only in relation to the disability issues);• the Claimant did not provide an Agenda for the hearing on 8 May 2024;• the Claimant did not respond to the tribunal’s request dated 22 April 2024 that she indicate by 29 April 2024 that she was ready for the hearing on 8 May 2024;• the Claimant did not attend the hearing on 8 May 2024.[2]The claimant has failed to make representations in writing, or has failed to make any sufficient representations, why this should not be done or to request a hearing. The claim is therefore struck out.[3]The hearing fixed for 15th July 2024 will not take place.
