JUDGMENT

Employment Tribunals Rules of Procedure 2013 – Rule 21[1]The Respondent has failed to enter a response to the claim.[2]The claims of failure to pay wages, holiday pay and notice pay succeed.[3]The respondent has made unauthorised deductions from the Claimant's wages for the months of June, July and 1 -7 August 2018. The Respondent is ordered is ordered to pay the Claimant the net sums of £1,578 (June) +£1,630.60 (July) + £368.20 (August). That makes a total net sum of £3,576.80[4]The Claimant was dismissed in breach of contract in respect of notice and the Respondent is ordered to pay damages to the Claimant in the sum of one weeks pay in the net sum of £369.23.[5]The Respondent has failed to pay the Claimant’s accrued 13 days holiday pay holiday entitlement and is ordered to pay the Claimant the net sum of £683.80.[6]Any liability for tax on the above payments lies with the Respondent.[7]The hearing listed on 14 January 2019 is cancelled.
