JUDGMENT

Employment Tribunals Rules of Procedure 2013 – Rule 21[1]The Respondent does not resist the claim. The Claimant’s complaints of failure to pay a redundancy payment, accrued holiday pay and outstanding notice pay succeed.[2]The Claimant was dismissed in breach of contract in respect of notice and the Respondent is ordered to pay damages to the Claimant of one weeks’ notice pay at £493 a week in the gross sum of £493[3]The Claimant was dismissed by reason of redundancy. He was continuously employed for 7 years, earned a gross weekly wage of £493 and was 35 at date of termination. He is entitled to a redundancy payment of £3,451 (7 X £493)[4]The Respondent has failed to pay the claimant’s holiday entitlement and is ordered to pay the claimant the sum of £ 380.43[6]The hearing listed on 19 December 2018 is cancelled.
