Employment Tribunals Rules of Procedure 2013 – Rule 21[1]The Respondent does not resist the claim. The Claimant’s complaints of failure to pay a redundancy payment, accrued holiday pay and outstanding notice pay succeed.[2]The Claimant was dismissed in breach of contract in respect of notice and the Respondent is ordered to pay damages to the Claimant of one weeks’ notice at £480 a week in the gross sum of £480[3]The Claimant was dismissed by reason of redundancy. She was continuously employed for 7 years, earned a gross weekly wage of £480 and was 39 at date of termination. She is entitled to a redundancy payment of £3,360 (7 X £480)[4]The Respondent has failed to pay the claimant’s holiday entitlement and is ordered to pay the Claimant the sum of £ 320.[6]The hearing listed on 19 December 2018 is cancelled.
