JUDGMENT
[1]The parties have agreed to a settlement of the claims for holiday pay and breach of contract.[2]On or before 6 January 2019 the Respondent shall pay the following sums:(i) £230.76 gross pay for 2 days accrued and unpaid holiday. The Respondent shall be entitled to deduct and account to HMRC for tax and national insurance contributions on this amount of holiday pay.(ii) £60 in compensation for pension contribution (not recoverable from the pension scheme) which the Claimant did not want or intend to pay.[3]These proceedings shall be stayed until 6 January 2019. If there is no further application from either party on or before 5.00pm on that date then the claims will be automatically dismissed without further notice or correspondence or any further hearing. [1]By a letter dated 22nd October 2018 the Tribunal gave the claimant an opportunity to make representations or to request a hearing, as to why the claim should not be struck out because• it has not been actively pursued.[2]The claimant has failed to make representations in writing, why this should not be done or to request a hearing. The claim is therefore struck out.[3]The hearing previously fixed for 13 November 2018 and postponed will not now be re-listed.
