JUDGMENT

[1]The claimant's claim that the respondent failed in its statutory duty to make reasonable adjustments was presented to the Tribunal out of time in circumstances when it would not be just and equitable to extend time to the date of eventual presentation. The claimant's disability discrimination claims are dismissed.[2]The claimant is in breach of a Case Management Order made on 11 January 2017 and sent to him on 17 January 2017, being an order to provide his medical records and a personal statement addressing the section 6 Equality Act 2010 definition of disability to the respondent; he has made partial disclosure only. Any consideration of a costs order consequent upon the claimant's breach is deferred to the conclusion of the claim of unfair dismissal which is to be listed for a final hearing.

REASONS

[1]By a letter dated 20/06/2017 the Tribunal gave the claimant an opportunity to make representations or to request a hearing, as to why the claim should not be struck out because  the claimant had not complied with the Case Management Order of the Tribunal dated 03/05/2017.  it has not been actively pursued.[2]The claimant has failed to make representations in writing, or has failed to make any sufficient representations, why this should not be done or to request a hearing. The claim is therefore struck out.[3]The hearing fixed for 17-18/07/2017 will not take place.
