JUDGMENT
[2]The Employment Judge is satisfied that a determination of the claims can be properly made.[3]The claims of race discrimination and disability discrimination SUCCEED.[4]A remedy hearing of 3 hours duration is required and shall take place on Wednesday 22 January 2020 commencing at 10am at East London Hearing Centre.[5]The Respondent shall only be entitled to participate in the Remedy Hearing to the extent permitted by the Judge. Case Number: 3201909/2019[1]The Respondent has applied for the default judgement on liability to be re-considered. The judgment is dated 11 December 2019, sent to the parties on 23 December 2019 and the application for reconsideration was lodged on 2 January 2020.[2]By reason of administrative error this application was not referred to the Employment Judge until 20 January 2020.[3]Meanwhile the Claimant has consented, by letter dated 14 January 2020, to a revocation of the default judgment and a case management preliminary hearing has been listed on 22 May 2020 before a Judge sitting alone; any Employment Judge may conduct this Hearing. This preliminary hearing was originally listed for 22 January 2020 but a postponement has been granted.[4]In all the circumstances and for the avoidance of doubt, I therefore grant the application for reconsideration and hereby revoke the Default Judgment pursuant to Rule 70 Employment Tribunals (Rules of Procedure) Regulations 2013.
