The claim is struck out.

REASONS

[1]In a case management order dated 11 January 2024 the Tribunal gave the Claimant an opportunity to make representations or to request a hearing, as to why the claim should not be struck out because: the manner in which the proceedings have been conducted by or on behalf of the Claimant has been unreasonable in that she did not attend a hearing she was aware was taking place; the Claimant is not actively pursuing her claim.[2]The Claimant wrote to the Tribunal on 21 January 2024. In her email she indicated that she would continue not to actively pursue the claim because of an alleged failure of the Respondent to comply with a data subject access request. The Claimant did not in her email say why the claim should not be struck out nor did she request a hearing. Therefore, in circumstances where the Claimant indicates that she does not intend to actively pursue the claim it is appropriate to strike the Claim out.
