JUDGMENT

[1]The correct name of the respondent is Flambard Williams Ltd. The Tribunal’s records will be amended accordingly.[2]The claimant’s claim for unauthorised deduction of wages in respect of the failure to pay the claimant commission is well-founded and succeeds. The respondent shall pay the claimant £500.00 (subject to deduction of income tax and National Insurance).[3]When the proceedings were begun the respondent was in breach of its duty to the claimant under section 1(1) or 4(1) of the Employment Rights Act 1996 (duty to give a written statement of initial employment particulars). The respondent shall pay the claimant two weeks’ pay - £923.08 (payable gross).
