JUDGMENT
UPON it being agreed that the second appeal will consider whether the Claimant satisfies the medical disability retirement criteria now (i.e. as at today’s date) based on the Claimant’s medical history and that there would be no further appeal or reconsideration of the same medical evidence; AND that the Claimant shall attend on any medical practitioner that he wishes to provide medical evidence as soon as practicable and shall use reasonable endeavours to produce any additional medical report that he wishes to rely upon within 14 days and in any event within 42 days; AND UPON it being agreed that neither side will make any application for costs:-[1]The Claim is dismissed upon withdrawal.
