JUDGMENT
[1]Time was not extended for a Response to be presented.[2]The Complaint of unauthorised deduction from wages is well founded.[3]The Respondent is Ordered to pay the Claimant the sum of £4,232.00 being the gross pay for August 2023 due on 1 September 2023, from which the Respondent is Ordered to make the deductions and remittances to the statutory authorities for tax and national insurance.[4]The net pay Ordered to be paid to the Claimant is £3025.50, the Respondent having made those deductions and remittances. The net pay provides for the deduction of pension contributions to prevent double recovery, because they were ordered to be refunded to the Claimant in the Order of 4 March 2024.[5]In addition, the Respondent is Ordered to pay the Claimant the sum of £200 under section 24(2) of the Employment Rights Act 1996 to compensate the Claimant for the financial loss attributable to the unlawful deduction. That is payable in full.[6]The total sum the Respondent is Ordered to pay to the Claimant pursuant to this Order is £3235.50.
