JUDGMENT

[1]The Claimant’s claim for unlawful deductions/ failure to pay wages contrary to section 13 of the Employment Rights Act 1996 succeeds in the following amounts:(i) the sum of £1,663.87 in respect of unpaid wages (210.35 hours at the net hourly rate of £7.91);(ii) the sum of £73.64 net in respect of the underpayment of wages for the equivalent of 9.31 hours;(iii) the Claimant’s outstanding share of the 12 ½ service charge received by the Café during the periods in which he worked (the amount to be determined).[2]The claim for failure to pay outstanding holiday due at the termination of employment, in accordance with Regulation 14 of the Working Time Regulations 1998 succeeds in the net sum of £355.75.
