JUDGMENT

[1]The Claimant has leave to amend her claim to include a claim for holiday pay.[2]The Claimant’s claim for unlawful deductions/ failure to pay wages contrary to section 13 of the Employment Rights Act 1996 succeeds in the following amounts:(i) 2 months unpaid wages in the net sum of £3,510.44, (being the net amount of £1,755.22 per month, or £505.05 per week);(ii) the sum of £129.22 under section 24 (2) of the Employment Rights Act to compensate the Claimant for her financial loss attributable to her employer’s failure to pay her wages when lawfully due.[3]The claim for failure to pay for outstanding holiday due at the termination of her employment in accordance with Regulation 14 of the Working Time Regulations 1998 succeeds in the amount of £405.05 net. Case Number: 3201530/2018[4]The claimant’s claim for notice pay succeeds in the sum of £405.05 net.
