JUDGMENT
The judgment of the Tribunal is that the Claimant is awarded the sum of £130 gross for 13 hours that she worked and for which she was not paid by the Respondent.REASONS
[1]The Claimant entered a Claim Form confirming that she worked for the Respondent and entered into a contract of employment whereby she would be paid £10 per hour. She worked as a care assistant in a nursing home and worked 13 hours typically per day. The Claimant stated that she was not paid for one shift of 13 hours equating to a total of £130 gross.[2]Although the Claimant did not attend the Tribunal in person she did confirm by email that she wished the matter to be determined on the papers including the Claim Form as well as a timesheet for Monday 28 January 2019 which was the shift that she worked and for which she was not paid.[3]The Respondent did not enter an appearance and did not attend the Tribunal hearing. Case Number: 3201374/2019[4]After reviewing the Claim Form and the Claimant’s timesheet for 28 January 2019 noting that the Claimant undertook 13 hours for that day for which she said she was not paid, the Tribunal ordered the Respondent to pay the Claimant a gross sum of £130 being at the rate of £10.00 per hour.
