JUDGMENT

[1]At the relevant times of 2017 to 2019 the claimant was a disabled person as defined by section 6 Equality Act 2010 because of emotionally unstable/borderline personality disorder.[2]The question as to whether the claimant was at a substantial disadvantage during the period of 2017 to 2019 is a question for the Tribunal at the full merits hearing.[3]The complaint of failure to make reasonable adjustments (s. 20 & 21 Equality Act 2010) was not presented within the applicable time limit, but it is just and equitable to extend the time limit.[4]The complaints of failure to make reasonable adjustments can therefore proceed. Case Number: 3201302/2023[5]The claims of discrimination arising from disability (s. 15 Equality Act 2010) and harassment related to disability (s. 26 Equality Act 2010) were not presented within the applicable time limit.
