Employment Tribunals Rules of Procedure 2013 – Rule 21[1]The respondent has failed to enter responses to the claimants’ claims by 2 November 2017, notwithstanding the claims were both correctly served on the company’s registered office.[2]Judgment for liability for race discrimination, breach of contract, and unlawful deductions from pay (holiday pay) is given for the claimants.[3]The claims all succeed and the remedy to which the claimants are entitled will be determined at a Remedy Hearing, to be listed in due course.[4]The hearing listed on 4 December 2017 is cancelled. REMEDY JUDGMENT[1]It is the judgment of the Tribunal that the Respondent shall pay the Claimants compensation in the following sums:- Miss Ndey Fatou Saine Injury to feelings: £10,000.00 Loss of earnings: £864.00 Holiday pay: £216.00 TOTAL: £11,080.00 Miss Haddy Saine Injury to feelings: £10,000.00 Loss of earnings: £1,728.00 Holiday pay: £216.00 TOTAL: £11,944.00[2]The Claimants’ complaints of unfair dismissal are dismissed upon withdrawal.[3]The Claimants’ application for costs is dismissed.
