JUDGMENT

[1]At the relevant times the claimant was a disabled person as defined by section 6 Equality Act 2010 because of sleep apnoea.[2]The complaint of unfavourable treatment because of something arising in consequence of disability is well-founded and succeeds.[3]The respondent shall pay the claimant the following sums: 3.1. Compensation for financial losses: £23,400 gross; 3.2. Interest on compensation for past financial losses calculated in accordance with the Employment Tribunals (Interest on Awards in Discrimination Cases) Regulations 1996: £2,697.73 gross; 3.3. Compensation for loss of pension: £395.88 gross. 3.4. Compensation for injury to feelings: £9,000; Case Number: 3201068/2024 3.5. Interest on compensation for injury to feelings calculated in accordance with the Employment Tribunals (Interest on Awards in Discrimination Cases) Regulations 1996: £1,037.59 gross.[4]The Respondent is to pay the Claimant the compensation for financial losses as net payments following the deduction of tax and national insurance as required.[5]The Compensation for injury to feelings is to be paid without deduction.[6]The recoupment to be made from the compensatory award to the claimant is the sum of £4,201.50.
