By a Rule 21 Judgment sent to the parties on 13 August 2018, the Claimant’s claims succeeded. The Claimant is awarded the following sums by way of remedy:(1) Unfair dismissal (i) Basic award: £1,443.00 (2 years employment x 1.5 x £481 p/wk) (ii) Loss of earnings: £7,559 (15 January to 5 June 2018 x £392 p/wk net, less credit of £720 for sums earned in mitigation; plus £360 future loss of earnings) (iii) Expenses incurred in finding new employment: £32 (iv) Loss of statutory rights of £450(2) Unauthorised deduction from wages: £2,521.00 (1 December 2017 to 15 January 2018)(3) Failure to provide written particulars of employment: £1,568 (4 weeks’ pay)(4) 20% uplift for unreasonable failure to follow the ACAS Code of Practice: £2,714.60 10.2 Judgment - rule 61 February 2018 Case No: 3200935/2018(5) No order as to costs.
