[1]The claims of failure to pay one weeks notice pay, unlawful deductions from wages and failure to pay holiday pay succeed.[2]The respondent is ordered to pay to the claimant the following sums: i. One weeks pay in lieu of notice in the sum of £680 together with pension contributions on that sum of £17; ii. The balance of two hours wages at £16 an hour in the sum of £32 together with pension contributions of £0.80; iii. Pension contributions on the 49 hours wages due when the claim was commenced and paid since proceedings commenced in the sum of £20.03; iv. Pension contributions due on the holiday pay due and paid since proceedings commenced of £13.60; v. £350 in respect of 5 overtime jobs worked but not paid together with pension contributions due on them of £8.75.[3]The payments due are gross sums. Any tax is payable by the Claimant.[4]After hearing the Claimants evidence and entering judgment for the Claimant I did a search on the companies house website and discovered the company had gone into administration on 9 July 2019. In these circumstances the proceedings cannot continue and the Judgment cannot stand without the leave of the court or the administrators being given.
