[1]By a letter dated 14 August 2021, the Tribunal gave the claimant an opportunity to make representations or to request a hearing, as to whether the claimant should withdraw the claim because it may have been brought against a company that had never employed the claimant. The claimant has not responded to that letter, disputing the contents of the ET3. Accordingly the Tribunal considers:• the claim has no reasonable prospect of success.• the claim is not been actively pursued.[2]The claim is therefore struck out.[3]The hearing fixed for 28 September 2021 will not take place.
