JUDGMENT
[1]The complaint that the First Respondent failed to comply with the requirements of section 188 of the Trade Union and Labour Relations (Consolidation) Act 1992 is well-founded. The First Respondent has not shown that there were special circumstances that rendered it not reasonably practicable to comply.[2]The Tribunal makes a protective award: 2.1. in respect of all claimants in the schedule attached at appendix 2 hereto; 2.2. the protected period is 35 days from 6 February 2024. 2.3. the parties did not wish us to enumerate the award for each claimant.[3]Recoupment applies. See the recoupment notice attached at appendix 1 hereto.
