JUDGMENT

[1]The Claimant’s claim for unlawful deduction of wages succeeds. The Respondent paid the Claimant the gross sum of £5206.15 when it should have paid the Claimant £5423.10 (30 x £180.77). There is therefore a shortfall of £216.95. The Respondent is ordered to pay the Claimant this gross sum.[2]The Respondent has failed to provide the Claimant with a written statement of terms and conditions of employment. The Respondent is ordered to pay the Claimant 2 weeks pay pursuant to section 38 of the Employment Act 2002. The amounts to £1807.70 (2 x £903.85)[3]The Respondent is therefore ordered to pay the Claimant the total sum of £2024.65.[4]As the gross figure is used, the Claimant will be liable for tax on the elements relating to pay and as such he will have to account for Income Tax and National Insurance contributions to HMRC separately in respect of such sums.
