The judgment of the Tribunal is as follows: Strike out of claim The claim is struck out under Employment Tribunal Rule 38(1)(a) because it has no reasonable prospect of success. The Tribunal has taken account of Rule 74(2). The Tribunal has also taken account of Rule 75 and has considered that the Claimant has not had an adequate opportunity to make representations. As such, the Tribunal takes the view that it is precluded, at this time, from considering whether to make a costs order. The Tribunal reminds the parties of their right to make an application for costs under Rule 75(1), as advised.
