The claim of unfair dismissal is struck out.REASONS
[1]By a letter dated 19 May 2023 the Tribunal gave the Claimant an opportunity to make representations as to why the claim should not be struck out because on the information supplied by him in his ET1 he has less than two years’ continuous service and is not entitled to bring a claim for unfair dismissal (section 108 Employment Rights Act 1996) and there appeared to be no applicable exceptions to this rule. The Claimant was required to do by 2 June 2023.[2]The claimant has failed to make any representations in writing why this should not be done or to request a hearing by 2 June or at all. The claim is therefore struck out.[3]The hearing fixed for 14 September 2023 will proceed in respect of the Claimant’s other claims.
