Mr L Thompson v Acola Kids Ltd: 3200795/2022
JUDGMENT
The complaint of unpaid redundancy payment is struck out.REASONS
[1]By a letter dated 30th March 2022 the Tribunal gave the claimant an opportunity to make representations or to request a hearing, as to why the complaint of unpaid redundancy payment should not be struck out because it has no reasonable prospect of success.[2]The claimant has failed to make representations in writing, or has failed to make any sufficient representations, why this should not be done or to request a hearing. The complaint of unpaid redundancy payment is therefore struck out.[3]The claimant’s remaining claim(s) remains listed for a remedy hearing on 27th July 2022.[1]The claim was issued in the London East Employment Tribunals on 30th March 2022. The respondent has failed to present a valid response on time. The Employment Judge has decided that a determination can properly be made of the claim, or part of it, in accordance with rule 21 of the Rules of Procedure.[2]The respondent has made unauthorised deductions from the claimant’s wages.[3]The claimant was dismissed in breach of contract in respect of notice and the respondent must pay damages to the claimant.[4]The claim succeeds and the remedy to which the claimant is entitled will be determined at a Remedy Hearing on the 27th July 2022.
