JUDGMENT
Having regard to correspondence from the liquidator and the Redundancy Payments Office and having considered the Claimant’s evidence and the Respondent’s letter to the Claimant dated 15th January 2024, the judgment of the Tribunal is as follows: Notice Pay[1]The complaint of breach of contract in relation to notice pay is well-founded.[2]The respondent shall pay the claimant £3,755.32 as damages for breach of contract. This figure has been calculated using gross pay to reflect the likelihood that the claimant will have to pay tax on it as Post Employment Notice Pay.[3]This figure is the Claimant’s gross monthly pay (of £4,166.67) less £411.35 that the Claimant has been paid as notice pay by the Redundancy Payments Office. Interest[4]Interest will accrue at a rate of 8% per annum on any amount of this award that remains unpaid 14 days after the date of this Judgment: see Employment Tribunal Case Number: 3200734/2024 (Interest) Order 1990 and s17 Judgments Act 1838. This means if the whole amount remains unpaid it will accrue interest at a rate of £0.82 per day.
