JUDGMENT
[1]The parties’ application for postponement of the final hearing is refused as the application was made less than seven days before the final hearing began. There have been two previous postponements of the final hearing and no exceptional circumstances apply.[2]All the claimant’s claims and both the respondents’ responses are struck out in their entirety under Rule 38(1)(b-e) inclusive of The Employment Tribunal Procedure Rules 2024 on the following grounds: (b) that the manner in which the proceedings have been conducted by or on behalf of the claimant and the respondents has been unreasonable; (c) for repeated non-compliance with the Rules or with multiple orders of the Tribunal by all parties; (d) that the claims and responses have not been actively pursued; and 1 of 2 Case Numbers: 3200672/2023 3200673/2023 (e) that the Tribunal considers that it is no longer possible to have a fair hearing in respect of the claims or responses.
