The unfair constructive dismissal claims against the First Respondent are dismissed. This was considered pursuant to paragraph 11 of the Order of Employment Judge Gardiner dated 6 October 2020. The claimants confirm that their constructive dismissal claims relate to the period after 17 September 2019, when the claimants’ employment transferred to the Second Respondent. No issue for determination by the Tribunal arises as between the First Respondent and the Claimants on those claims. The constructive dismissal claims continue against the Second Respondent. The First Respondent Case Numbers: 3200650/2020; 3200651/2020; 3200652/2020 remains a party to the disability claim brought by Ms Harper, now proceeding separately.
