JUDGMENT
[1]The claims of failure to pay a redundancy payment, breach of contract by failure to pay contractual notice pay, failure to pay holiday accrued but not taken on termination, unlawful deductions from wages, and failure to pay statutory lay off pay succeed.[2]The Hearing listed for 11 August 2017 will not now proceed.[3]The Respondent is ordered to pay to the Claimant the following sums:a. A redundancy payment of £2,934 calculated on 4 years continuous service all aged over 41 and a gross weekly wage of £576.92 capped at statutory maximum of £489;b. 4 weeks wages for the period 6 February 2017 to 6 March 2017 at £576.92 gross (£453.24 Net) in the sum of £2,307. 68 gross (£1,812.96 net);c. £1,964.04 in respect of one month’s contractual notice pay at £1,964.04 net a month;d. 10.76 days holiday accrued but not taken on termination and rounded up to 11 days at £115 gross a day (£90.65 net a day) in the sum of £1,269.18 gross (£997.15 net);e. 5 days Guarantee pay (statutory maximum) in respect of statutory lay off at £26 a day in the sum of £130 from 7 March 2017.
