JUDGMENT

[1]The undefended complaints of a series of unauthorised deductions of wages contrary to s.13 Employment Rights Act 1996, by way of a wholesale failure to pay any salary from 1 March 2025 to 31 October 2025, is, in the case of each of the Claimants, well-founded and succeeds.[2]The Respondent failed unreasonably to comply with the ACAS Code of Practice on Grievance and Disciplinary Procedures and the awards (save for the pension element) below are uplifted on a just and equitable basis pursuant to s.207A Trade Union and Labour Relations Consolidation Act 1992 by 25% in each Claimant’s case.[3]Compensation is assessed and awarded (gross) as follows:(a) Mr. Joel Ithier: £150,000.00 inclusive of an uplift of £30,000.00 plus £3,600.00 (pension) totalling £153,600.00. Case Number: 3200467/2025(b) Mr. Christopher Weir: £108,833.30 inclusive of an uplift of £21,666.66 plus £2,600.00 (pension) totalling £111,433.30.[4]The Respondent must pay the Claimants the sums above within 14 days of this Judgment being sent to the parties.
