JUDGMENT
Employment Tribunals Rules of Procedure 2013 – Rule 21[1]The Respondent has made an unauthorised deduction from the Claimant's wages and is ordered to pay the Claimant the gross sum of £4383.34, being:a. £216.67 as the pension contribution deducted from the Claimant’s pay in October 2019, which has not been paid into the Claimant’s pension plan; andb. £4166.67 as the salary due in respect of November 2019.[2]The Respondent is in breach of contract in failing to pay the Claimant the employer’s pension contributions for October 2019 and November 2019 at the rate of 5.2%, being £433.33.[3]The hearing listed on 12 June 2020 is cancelled.
