JUDGMENT

[1]The Claimant’s representative explained that they considered that the matter had been settled and were awaiting a final agreement to sign. The Respondent explained that no settlement had been reached and their instructions were to continue with the preliminary legal points. Neither party was ready for a final hearing.[2]Upon the Claimant agreeing he was not an “employee” as would be required to bring a claim of unfair dismissal, the claim of unfair dismissal was withdrawn. The Claimant clarified that he was seeking to bring further claims that included unlawful deduction of wages, unlawful detriment for asserting a statutory right and breach of contract.[3]Upon the Claimant agreeing that this claim was expressly limited to a claim for unfair dismissal and did not include any other claim as per omissions and/or significant lack of particularisation in his ET1 for unfair dismissal he consented to it being dismissed and explained that he would give consideration as to whether he would submit a new claim. The Tribunal explained that any new claim would need to address the passage of time since the alleged detriments/ breach of contract. Accordingly, the claim was withdrawn and dismissed.
