JUDGMENT
[1]The complaint that the Respondent failed to comply with the requirements of section 188 of the Trade Union and Labour Relations (Consolidation) Act 1992(“the 1992 Act”) is well founded.[2]The Tribunal makes a protective award in respect of the Claimants listed in the Schedule to this Judgment, being employees of the Respondent who were dismissed as redundant on 20 January 2025.[3]The Respondent is ordered by way of protective award under section 189(3) of the 1992 Act to pay the Claimants remuneration for the protected period of 90 days beginning on 20 January 2025.[4]The Employment Protection (Recoupment of Jobseeker’s Allowance & Income Support) Regulations 1996 apply and attention is drawn to the Annex to this judgment.
