JUDGMENT
Upon hearing the evidence of Mr D Trion and having heard the submissions of both the Claimant and the Respondent’s representative:[1]The Respondent’s application for an extension of time to present the Response, pursuant to Rule 20 of the Employment Tribunal Rules of Procedure is allowed.[2]The Claims in respect of section 10 National Minimum Wage Act 1998, section 23 Employment Rights Act 1996 and Regulation 13 Working Time Regulations 1998 are out of time and it was reasonably practicable for the Claimant to bring such claims within the three-month time limit.
