JUDGMENT

[1]The Claimant’s claims of disability discrimination have been presented outside the primary time limit contained in section 123 of the Equality Act 2010.[2]Having regard to the effects of the Claimant’s condition, it is just and equitable to extend time to 1 February 2018 for bringing the complaint that the Claimant’s alleged constructive dismissal on 23 June 2017 (on the expiry of his notice given on 28 April 2017) was an act of disability discrimination. Accordingly, the Tribunal has jurisdiction to decide claims concerning this act.[3]The question whether the Claimant’s other claims have been presented in time by reason of their being part of a continuing act culminating in the alleged dismissal or whether it is just and equitable to extend time for them shall be decided at the final hearing.
