JUDGMENT
The claims are struck out under Rules 39(4), 38(1) and 37(1)(c) of the Tribunal Rules 2013.REASONS
[1]The Claimant was ordered to pay a deposit of £1,000 (in relation to her unfair dismissal claim) by 14th October 2022, following a preliminary hearing held on 1st September 2022. The Order was sent to the Claimant on 5th September 2022. The Claimant has failed to pay this deposit. The complaint of unfair dismissal is therefore struck out under Rule 39(4) of the Employment Tribunals Rules of Procedure 2013.[2]The Claimant was also ordered to send to the Tribunal and the Respondent a Schedule of Loss by 14th October 2022 (an Unless Order). The Claimant has failed to do so. Her remaining complaint of race discrimination is therefore struck out under Rules 38(1) and 37(1)(c) of the Tribunal Rules of Procedure 2013.[3]The hearing fixed for 5th, 6th, 7th and 8th December 2023 will not take place.
