JUDGMENT
[1]The Respondent is ordered to pay the Claimant compensation in the agreed sum of £46,224.59[2]The Respondent is ordered to pay the Claimant costs in the sum of £13,237.20.[3]The Respondent has paid fees in connection with this claim. In R (on the application of UNISON) v Lord Chancellor [2017] UKSC 51 the Supreme Court decided that it was unlawful for Her Majesty's Courts and Tribunals Service (HMCTS) to charge fees of this nature. HMCTS has undertaken to repay such fees. In these circumstances I shall draw to the attention of HMCTS that this is a case in which fees have been paid and are therefore to be refunded to the respondent. The details of the repayment scheme are a matter for HMCTS. The Claimant’s application for the Respondent to be ordered to reimburse him such fees is in the meantime, stayed.[4]The recoupement provisions apply to this Judgment. The grand total is £46,224.59. The Prescribed Element is £21,168. The period of the Prescribed Element is 31 October 2016 to 14 August 2017. The excess of the grand total over the Prescribed Element is £25,056.59.
