JUDGMENT
[1]The claimant’s claim for an unauthorised deduction from wages on 8 May 2020 was presented outside of the time limit but it was not reasonably practicable for it to be presented in time and it was issued within such further period as was reasonable within the meaning of s.23 of the Employment Rights Act 1996.[2]The respondent made an unauthorised deduction from wages by failing to pay the claimant all the wages due on 8 May 2020 and 14 August 2020 and is Ordered to pay to the claimant the sum of £433.98 being the gross sum unlawfully deducted subject to deductions for tax and national insurance.[3]The respondent made an unauthorised deduction from wages by failing to pay the claimant the correct amount in lieu of accrued but untaken holiday and is Ordered to pay to the claimant the sum of £333.44 being the gross sum unlawfully deducted subject to deductions for tax and national insurance.[4]The respondent was in breach of contract by failing to pay the correct amount of notice pay to which was she was entitled and the respondent is Ordered to pay to the claimant damages of £135.00 being the gross sum subject to deductions for tax and national insurance.
