JUDGMENT

The claim is struck out.

REASONS

[1]By a letter dated 22 January 2022 Employment Judge Adkinson directed that as the Respondent is in administration pursuant to The Insolvency Act 1986 schedule B1 para 43 (6) no legal proceedings may be instituted or continued without the permission of the Court or administrator. The case was therefore stated for 6 months from that date pending the administration ending, the administrator consenting or the Court granting permission for the case to proceed.[2]The Claimant was contacted by the Tribunal on 9 August 2022 and asked to provide an update on the proceedings by 16 August 2022. No response was received from the Claimant.[3]A strike out warning was sent to the parties, warning the Claimant that Employment Tribunal was considering striking out the claim because it was not being actively pursued and the Claimant was invited to give her reasons in writing or request a hearing at which she could make representations, as to why the claim should not be struck out, by 23 September 2022. The Claimant has not replied to that letter and no representations have been received.[4]The Claimant has failed to make representations in writing why the claim should not be struck out on the grounds that it has not been actively pursued . The claim is therefore struck out.
