JUDGMENT

[1]The claim has more than little reasonable prospect of success. As such:a. it is not struck-out;b. no deposit order is made. _____________________________ Employment Judge Dyal Date: 08.10.2020 Case no. 2603625.2019 SENT TO THE PARTIES ON 13 October 2020 ........................................................................ ........................................................................ FOR THE TRIBUNAL OFFICE[2]Case Number: 2603625/2019 EMPLOYMENT TRIBUNALS Claimant: Mrs O Elhety Respondent: Newlyn Plc

REASONS

[1]By a letter dated 5 June 2021 the Tribunal ordered that the claimant by 17 June 2021 confirm that she had complied with disclosure in accordance with the order of Judge Dyal on 8 October 2020 and if not, why not. The claimant was warned that if she had not complied with the order for disclosure, the file will be referred to a Judge to determine whether the claim should be struck out as not being actively pursued. The claimant was given an opportunity to make representations or to request a hearing, if she objected to this proposal.[2]The Tribunal has not received confirmation that the claimant had complied with the order for disclosure.[3]The claimant has failed to make representations in writing, or has failed to make any sufficient representations, why the claim should not be struck out or to request a hearing. The claim is therefore struck out.
